Just as it should be. Many (most?) will throw a protest, valid or not, just as a hail Mary in the off chance they'll get it changed. This costs money. That the taxpayer should foot the bill is absurd. Hope this goes through.

The protest sustain rate is not a useful metric since most of the protests get dismissed
before formal adjudication as a result of preliminary judgements in non-binding arbitration (sorry for the legalese).

As a result of the prelim judgement, the contracting agency will typically elect to redo the
competition/evaluation or the protestor will see that it is likely to lose and withdraw the protest.

And GAO already has the right to recover costs for protests that it deems frivolous.

Making GAO protests quick and easy keeps the contractors from dragging the government
into the court of Federal Claims.
